Terms of Service

These terms of service govern the services offered by Metabole Studio. Any subscription to an offer implies full and complete acceptance of these terms.

1. Purpose

Metabole Studio provides web design, hosting and technical maintenance services. These terms define the rights and obligations of the parties in the provision of these services.

2. Description of services

The services may include in particular:

• creation or integration of a website,
• hosting of the site on a cloud infrastructure,
• technical maintenance and updates,
• monitoring and management of the infrastructure.

The exact nature of the services depends on the offer subscribed to by the client.

3. Hosting and infrastructure

Sites are hosted on a cloud infrastructure operated by specialized third-party providers, including the Vercel platform.

Metabole Studio acts as a technical intermediary for the setup and management of this infrastructure.

The availability and performance of the services also depend on the infrastructures operated by these providers and their own terms of use.

4. Resource usage and usage-based billing

The hosting provided includes normal use of the technical resources necessary for the operation of the site.

Certain cloud infrastructure resources may be billed on a usage basis by infrastructure providers, including:

• data transfer (bandwidth),
• server function execution,
• network requests,
• image processing,
• analytical or technical events.

When the site's actual consumption exceeds standard usage levels or generates additional costs from infrastructure providers, these costs may be passed on to the client.

Such situations may result in particular from:

• a sharp increase in traffic,
• viral or media coverage,
• a marketing campaign generating a large number of visitors,
• automated use or abnormal traffic.

In such cases, Metabole Studio may:

• pass on the actual infrastructure costs incurred,
• propose an upgrade to a suitable hosting plan,
• implement temporary technical limitations in order to preserve the stability of the service.

5. Subscription

Hosting services are offered on a monthly or annual subscription basis.

The subscription is automatically renewed at each billing period unless cancelled before the renewal date.

6. Payment

Payments are processed via the secure Stripe payment platform.

By subscribing to an offer, the client authorizes automatic billing of their payment method for the duration of the subscription.

In the event of payment failure, Metabole Studio reserves the right to temporarily suspend access to services until the situation is resolved.

7. Liability

Metabole Studio undertakes to use all reasonable means to ensure the availability, security and quality of the services provided.

As the services rely in part on third-party infrastructures, Metabole Studio cannot guarantee absolute availability and shall not be held liable for interruptions beyond its control, such as outages affecting partner platforms.

In the event of an incident, Metabole Studio undertakes to inform the client as soon as possible and to do everything possible to restore the service quickly.

8. Termination

The client may terminate their subscription at any time.

Termination must be notified to Metabole Studio with three (3) months' notice before the desired end-of-service date. This notice period ensures a smooth transition and, if necessary, support for site migration or handover.

Termination will take effect at the end of this notice period, at the end of the corresponding billing period, unless otherwise specified in the offer.

9. Modification of terms

Metabole Studio reserves the right to modify these terms of service at any time.

The new terms will apply as soon as they are published on this page.

10. Applicable law

These terms of service are governed by French law.

Any dispute relating to their interpretation or execution shall be submitted to the competent courts.
